Mahkamah putuskan perkataan 'Allah' boleh digunakan Herald Catholic Weekly

KUALA LUMPUR: Mahkamah Tinggi (Bahagian Rayuan dan Kuasa-Kuasa Khas) di sini, sebentar tadi memutuskan bahawa perkataan "Allah" boleh digunakan dalam penerbitan Herald Catholic Weekly.

Hakim Datuk Lau Bee La membuat keputusan itu selepas membenarkan permohonan semakan kehakiman oleh Gereja Katolik. Permohonan bagi semakan kehakiman berhubung penggunaan perkataan 'Allah' dalam penerbitan Herald Catholic Weekly itu dikemukakan oleh Ketua Paderi, Tan Sri Murphy Pakiam.

Pada 16 Februari lalu, Pakiam, sebagai penerbit akhbar berkenaan, mengemukakan permohonan baru bagi mendapatkan semakan semula penghakiman selepas permohonan serupa pada 2008 dianggap bersifat akademik berikutan tamatnya tempoh sah permit penerbitan itu pada 31 Disember 2008.

Dalam permohonan semakan kehakiman itu, Pakiam yang bertindak sebagai pemohon, menamakan Kementerian Dalam Negeri dan Kerajaan Malaysia sebagai responden, pertama dan kedua.

Pakiam, antara lain menuntut perisytiharan bahawa keputusan responden pada 7 Januari 2009 yang melarang beliau menggunakan perkataan 'Allah' dalam He-rald Catholic Weekly adalah menyalahi undang-undang dan perkataan 'Allah' bukan eksklusif untuk kegunaan agama Islam saja.

Court says ‘yes’ to Allah for Christians

KUALA LUMPUR, Dec 31 — It will be a glorious new year for some 850,000 Catholics in Malaysia.

In a landmark ruling today, the High Court here lifted the home minister’s ban against the Catholic church publishing the word “Allah” to refer to the Christian God in its weekly paper, Herald.

Counsel for the Herald, Porres Royan, told reporters outside the crowded court, “The court has granted the declaration that the applicant has the Constitutional right to use the word Allah. I believe the ministry is bound by the court’s decision.”

Senior Federal counsel Datuk Kamaludin Md Said said, “I was made to understand the ministry has already issued the permit for 2010.” The publishing permit for the Herald expires today.

He added that he will consult the ministry for new instruction, when asked about his next course of action.

The government had said that the ban was necessary to avoid confusing the majority Muslims in the country. Islam is the official religion in Malaysia.

But the church claimed the ban violates its constititutional rights to practice its religion freely.

According to Father Lawrence Andrew who edits Herald, the term “Allah” has been used by Christians in the region to refer to their God since four hundred years ago. He added that it is still actively used today.

Lawrence explained that “Allah” in the Christian context is used to refer to the trinitarian concept of “God the Father” which is different from the Muslim use of the verse to refer to the “one and only God”.

Herald’s editor claims the use of the word has not died out and is still being used in church worship among indigenous East Malaysians, who form a substantial number of the Christian faithful in the country.

The church first took the government to court last year after the home ministry threatened to revoke its annual publishing permit for Herald, Malaysia’s only Catholic paper.

It was forced to refresh its suit again this year after its 2008 permit expired without any decision from the court.

salam...keputusan ni x boleh dibuat rayuan semula ke?

Memang boleh buat rayuan tetapi kena lah cari bijak pandai dan pakar-pakar Islam yang boleh menterjemahkan perkataan 'Allah" serta perbezaan 'tuhan' dan ALLAH. Kalu dihantar peguam-peguam syarie yang hanya untuk mendendangkan lagu 'tak boleh' tak boleh .. lebih baik tak payah buat rayuan.

Dan sebagai KDN pula boleh menghalang meminda akta mesin cetak kalu perlu.. bagi memastikan tiada sesiapa pun orang Islam dibenarkan membeli apa-apa juga makalah, atau sebarang terbitan yang dikeluarkan oleh bukan Islam jika terdapat sebarang nama Allah ditulis dan dicetak.

Lebih baik tanya Tok AJis , Pak Khalis dan Pak Khalijok.

kalau bukan kerana anwar dan nik aziz bangsa asing dan penganut agama bukan islam tak pernah berani nak ganggu gugat ketenteraman islam dan bangsa melayu hari ini.Percayalah anak cucu dan generasi akan datang akan keliru dan akibat dari kekeliruan itu islam dinampakkan seperti bukan ugama yang syumul dan mereka akan mula tidak menitikberatkan hukum hakamnya,sedangkan sekarang ni pun kita lihatlah begitu ramai anak muda yang hanyut.
